TERMS AND CONDITIONS

1. AGREEMENT TO TERMS

These Terms and Conditions constitute a legally binding agreement made between you and Megan Sumrell, LLC, doing business as The Pink Bee ("we," "us," or "our"), concerning your access to and use of our website (www.megansumrell.com), products, services, courses, programs, memberships, social media platforms, podcast, and any related mobile applications (collectively, the "Services").

By accessing or using the Services, you agree that you have read, understood, and agree to be bound by all these Terms and Conditions. If you do not agree with these Terms and Conditions, you are expressly prohibited from using the Services and must discontinue use immediately.

We reserve the right to change, modify, or revise these Terms and Conditions at any time without prior notice. Your continued use of the Services following the posting of revised Terms and Conditions means that you accept and agree to the changes. We encourage you to review these Terms and Conditions periodically.

2. PRODUCTS AND SERVICES

The Pink Bee offers the following products and services:

  • Signature Programs: The TOP Program and TOP Operations
  • One-Time Purchase Courses: Including but not limited to TOP Bootcamp, Capacity Confidence Method, and The One Notebook Challenge
  • Membership Services: TOP Operations Membership with monthly live coaching calls
  • Physical Products: The TOP Planner (shipped to US addresses only)
  • Digital Products: Printable planners and resources (available worldwide)
  • Educational Content: Free resources, podcast episodes, and challenges

3. PURCHASES AND PAYMENT

All purchases are processed through Kajabi, which uses Stripe and PayPal for payment processing. By making a purchase, you agree to provide current, complete, and accurate purchase and account information. You further agree to promptly update account and payment information as needed to ensure successful transaction processing.

We reserve the right to refuse or cancel any order for any reason, including but not limited to product or service availability, errors in product or pricing information, or suspected fraudulent or unauthorized transactions. If your order is cancelled after payment has been processed, you will receive a full refund.

Digital Products: All digital courses, programs, and downloadable products are available for purchase worldwide. Access is granted immediately upon successful payment processing.

4. REFUND AND CANCELLATION POLICIES

4.1 The TOP Program - 60-Day Money-Back Guarantee

The TOP Program is the only course that includes a money-back guarantee. To qualify for a refund under this guarantee, you must:

  • Submit your refund request within 60 days of purchase
  • Have watched all course modules (which we can verify through our platform)
  • Submit proof of implementation by providing screenshots or photos demonstrating that you have implemented the weekly planning process as taught in the program

Refund requests will be reviewed by our team. If you have not completed the implementation requirements listed above, your refund request will be denied. Approved refunds will be issued for the program cost minus payment processing fees. Refunds are typically processed within 7-10 business days of approval.

4.2 All Other Digital Products

All purchases of digital products, courses, and programs other than The TOP Program are final. Due to the nature of digital products and immediate access upon purchase, we do not offer refunds for TOP Operations, TOP Bootcamp, Capacity Confidence Method, The One Notebook Challenge, or any other digital courses or resources.

4.3 TOP Operations Membership Cancellation

The TOP Operations Membership is a monthly recurring subscription that can be cancelled at any time. If you cancel your membership, you will retain access to the membership benefits (including live coaching calls) through the end of your current billing period. No partial refunds will be issued for unused portions of the current billing cycle. Upon cancellation, your access will automatically terminate at the end of the paid period, and you will not be charged again.

4.4 Physical Products - The TOP Planner

Refunds for physical products are only granted if the product arrives damaged. To request a refund or replacement for a damaged product:

  • Email [email protected] with a photo of the damaged product and your order number
  • We will review your request and provide either a replacement shipment or a refund at our discretion

The Pink Bee is not responsible for refunding products that are shown as delivered according to the tracking information provided. We cannot issue refunds for packages reported as lost, stolen, or misdelivered after confirmed delivery. Please ensure your shipping address is correct at the time of purchase.

5. SHIPPING (PHYSICAL PRODUCTS)

Physical products (The TOP Planner) are shipped only to addresses within the United States. We use RSVP fulfillment services for order processing and shipping. Shipping times and costs vary based on your location and selected shipping method.

We are not responsible for delays caused by the shipping carrier, customs processing, weather conditions, or other circumstances beyond our control. Once a package is confirmed as delivered by the shipping carrier, we are not responsible for lost, stolen, or misdelivered packages.

Digital printable versions of The TOP Planner are available for worldwide purchase and immediate download.

6. INTELLECTUAL PROPERTY RIGHTS

All content, materials, tools, processes, strategies, course materials, videos, worksheets, templates, graphics, logos, designs, and information presented through the Services ("Content") are the exclusive property of Megan Sumrell, LLC and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are expressly prohibited from:

  • Recording, screen capturing, photographing, or otherwise reproducing any portion of our courses, programs, or materials
  • Duplicating, distributing, selling, reselling, or sharing course content or materials with others
  • Teaching, training, or creating derivative works from our proprietary concepts, methods, or materials
  • Modifying, copying, translating, or creating derivative works based on our Content
  • Using our Content for any commercial purpose without express written permission

Your purchase grants you a non-exclusive, non-transferable, personal license to access and use the Content solely for your own personal, non-commercial use. This license does not grant you any ownership rights to the Content.

Any unauthorized use or distribution of our proprietary concepts, materials, and intellectual property is strictly prohibited and may result in immediate termination of your access to the Services, as well as legal action to protect our rights. We will pursue full damages for any violations of these intellectual property restrictions.

7. AFFILIATE PROGRAM

The Pink Bee operates an affiliate program managed through Kajabi. Anyone may apply to become an affiliate and promote our courses and programs in exchange for commissions on qualifying sales.

Affiliate Commission Structure:

  • Affiliates earn $99 for each TOP Program sale made through their unique affiliate link
  • Commissions are paid 60 days after the customer's purchase date to account for the TOP Program's money-back guarantee period

Affiliate Requirements and Restrictions:

  • Affiliates must disclose their affiliate relationship when promoting our products
  • Affiliates may not make false claims, guarantees of results, or misrepresent our products or services
  • Affiliates may not guarantee income, earnings, or specific outcomes to potential customers
  • We provide approved promotional images and graphics that affiliates may use; affiliates may not use our brand name, photos, or other content in paid advertising without express written permission

We reserve the right to terminate any affiliate relationship at any time for violation of these terms or for any other reason at our sole discretion. Unpaid commissions may be forfeited if an affiliate account is terminated for violations.

8. USER COMMUNITIES AND USER-GENERATED CONTENT

We operate the following community spaces:

  • Facebook Group: Open to anyone, whether or not you are a customer
  • Kajabi Community: Private community accessible only to students enrolled in The TOP Program and Next Level Planning

By participating in our communities, you agree to:

  • Treat all members with respect and kindness
  • Refrain from posting abusive, threatening, harassing, defamatory, vulgar, obscene, or otherwise objectionable content
  • Not use the communities for commercial solicitation or advertising without permission
  • Not post content that infringes on any intellectual property rights or violates any law
  • Not share, distribute, or republish course content, screenshots, or proprietary materials from our programs

We monitor our communities daily and reserve the right to remove any content or ban any user who violates these guidelines. We are not responsible for content posted by users and do not endorse user-generated content.

By posting content in our communities, you grant us a worldwide, perpetual, non-exclusive right to use, display, reproduce, and distribute your posts and contributions in any medium for promotional or educational purposes. You warrant that you own or control all rights to the content you post and that such content does not violate the rights of any third party.

9. PRIVACY AND DATA COLLECTION

We collect and process personal information necessary to provide our Services, including:

  • Email addresses for newsletter subscriptions, course access, and customer communications
  • Payment information processed securely through Kajabi (which uses Stripe and PayPal)
  • Names and shipping addresses for physical product orders (shared with our fulfillment partner RSVP)
  • Course progress and engagement data through Kajabi
  • Website analytics and tracking data through Facebook Pixel

All email marketing, course hosting, payment processing, and customer data management is handled through Kajabi. We do not collect podcast listener data. We do not sell or share your personal information with third parties except as necessary to provide our Services (such as sharing shipping information with our fulfillment partner).

By using our Services, you consent to our collection and use of your information as described. You may request access to or deletion of your personal information by contacting [email protected].

10. EDUCATIONAL AND INFORMATIONAL PURPOSES

All products, services, and content provided through The Pink Bee are for educational and informational purposes only. The information, strategies, and methods we teach are based on our personal experiences and opinions.

No Guarantees of Results: We do not guarantee any specific results from using our products, services, or information. Your success depends on many factors including your effort, commitment, circumstances, and business or personal situation. Past results and testimonials from other students are not guarantees of future results.

Not Professional Advice: The information we provide does not constitute legal, financial, medical, psychological, or other professional advice. We are productivity and time management educators, not licensed professionals in these fields. Always consult qualified professionals for advice specific to your situation.

You are solely responsible for your decisions, actions, and results. By using our Services, you agree not to hold us liable for any decisions, actions, or results that occur as a consequence of using our products or information.

11. DISCLAIMERS AND WARRANTIES

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Services will be uninterrupted, timely, secure, or error-free
  • The information provided through the Services will be accurate, reliable, or complete
  • Any defects or errors will be corrected
  • The Services or servers are free of viruses or other harmful components

You acknowledge that your use of the Services is at your sole risk. We reserve the right to change, suspend, or discontinue any aspect of the Services at any time without notice or liability.

We are not responsible for content posted by users in our communities or for any opinions, advice, or statements made by third parties through the Services.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEGAN SUMRELL, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100.00), WHICHEVER IS LESS.

13. ACCOUNT TERMINATION

We reserve the right to suspend or terminate your access to the Services at any time, for any reason or no reason, without notice or liability. Grounds for termination may include but are not limited to:

  • Violation of these Terms and Conditions
  • Unauthorized use or distribution of course content or materials
  • Fraudulent or illegal activity
  • Abusive or harassing behavior toward other users or our team

Upon termination, your right to access and use the Services will immediately cease. We are not obligated to provide refunds for terminated accounts. These Terms and Conditions, along with any provisions that by their nature should survive termination, will remain in effect after termination.

14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Megan Sumrell, LLC, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of the Services; (b) your violation of these Terms and Conditions; (c) your violation of any rights of another party; or (d) any content you post or share through the Services.

15. LINKS TO THIRD-PARTY WEBSITES AND SERVICES

The Services may contain links to third-party websites or services that are not owned or controlled by The Pink Bee. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

We do not endorse or make any representations about third-party websites or services. You access third-party websites and services at your own risk, and you should review the terms and privacy policies of any third-party website or service that you visit.

16. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State in which Megan Sumrell, LLC is registered, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms and Conditions or your use of the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in court to prevent or stop infringement of intellectual property rights.

17. SEVERABILITY

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the extent necessary to make it valid and enforceable while preserving its intent, or if that is not possible, shall be severed from these Terms and Conditions.

18. ENTIRE AGREEMENT

These Terms and Conditions, together with any other legal notices or policies published by us through the Services, constitute the entire agreement between you and Megan Sumrell, LLC regarding your use of the Services and supersede all prior agreements and understandings, whether written or oral.
